Pregnancy rights for Glendale employees (PDL and CFRA)

For most private employers, California law — not a separate Glendale pregnancy ordinance — is what controls. Two CRD-enforced frameworks often matter together:

Pregnancy Disability Leave (PDL) If your employer has five or more employees and you are disabled by pregnancy, childbirth, or a related medical condition, you may be entitled to up to four months of PDL per pregnancy. There is no minimum hours or tenure requirement for PDL eligibility beyond the pregnancy-related disability and covered employer size. Leave can be intermittent. Your health care provider should determine whether you have a pregnancy disability. Examples CRD lists include severe morning sickness, prenatal or postnatal care, bed rest, gestational diabetes, postpartum depression, lactation conditions such as mastitis, and recovery from loss or end of pregnancy.

California Family Rights Act (CFRA) bonding leave Separately, employers of five or more employees must provide eligible employees with up to 12 weeks of job-protected leave to bond with a new child (by birth, adoption, or foster placement) within one year of the event — and for certain family-care and medical reasons. CFRA bonding eligibility generally requires more than 12 months of service and at least 1,250 hours in the prior 12 months. CRD explains that CFRA leave for bonding is in addition to PDL; CFRA is not used for pregnancy-related disability itself (that is PDL’s role).

Federal FMLA may also apply for some workplaces (often 50+ employees within 75 miles, plus tenure/hours tests). When more than one law applies, employees generally receive the benefit of the more protective rules. For a statewide leave overview, see Leave of Absence (CFRA / FMLA) and Pregnancy Discrimination.

Discrimination and accommodations — not just leave

FEHA makes it illegal for covered employers to fire, refuse to hire, or otherwise discriminate because of pregnancy, childbirth, or a related condition. You may also be entitled to reasonable accommodations such as modified duties, a stool, temporary transfer to less strenuous work, longer or more frequent breaks, private lactation space, or PDL itself. An employer generally may not force you onto PDL if another reasonable accommodation would let you keep working.

Lactation: California rules require reasonable break time and a private place to express milk (not a bathroom). Related medical conditions during lactation may also support PDL.

Glendale workplaces where these issues arise

Healthcare, retail, restaurant, hospitality, and office jobs across Brand Boulevard and the Verdugo corridor often involve standing, lifting, fixed schedules, or customer-facing roles where accommodations and leave requests collide with staffing pressure. We look at your medical notes, request emails, and what happened next — we do not name employers as wrongdoers from a webpage.

Where Glendale pregnancy claims may go

  • CRD: Many FEHA pregnancy discrimination, PDL, and CFRA disputes are filed with CRD. Employment discrimination complaints generally must be filed within three years of the alleged act. You must file with CRD even if you want to sue in court.
  • EDD: Partial wage replacement through State Disability Insurance (SDI) or Paid Family Leave may be available through the Employment Development Department — that is a benefits path, not the same as job-protection enforcement through CRD.
  • Court: Civil cases may proceed in Los Angeles Superior Court. The Glendale Courthouse at 600 E. Broadway, Glendale, CA 91206 (North Central District) serves Glendale-area communities for many civil matters. Confirm filing location with the court’s locator.

CRD does not act as your personal lawyer.

What you may be able to recover

Depending on the claim, the evidence, and the forum, California law may provide remedies such as:

  • Back pay and, in some cases, front pay
  • Reinstatement to the same or a comparable job
  • Out-of-pocket expenses
  • Reasonable accommodations going forward
  • Damages for emotional distress
  • Punitive damages in appropriate cases
  • Attorney’s fees and costs when the law allows

No webpage can promise an outcome. Benefit amounts from EDD are separate from court or CRD remedies and are not quoted here.

What to do next

  1. Save medical certifications, accommodation requests, and HR responses.
  2. Keep a timeline of leave dates, return-to-work notes, and any discipline after you disclosed the pregnancy.
  3. Do not resign before a consultation if you can wait.
  4. Call MAGISA LAW at (888) 818-1099 before filing with CRD if you want counsel on timing and wording.

Frequently asked questions

Do I need a year on the job for pregnancy disability leave?

No. PDL eligibility does not require a year of service or 1,250 hours. CFRA bonding leave generally does. Many people use both, in sequence, when eligible.

Can my Glendale employer fire me for being pregnant?

Covered employers may not discriminate because of pregnancy, childbirth, or related conditions. Layoffs unrelated to pregnancy can still happen in limited situations — bring the facts to a free review.

Will I be paid on PDL?

Maybe. Pay can depend on employer temporary-disability policies, accrued sick leave you choose (or are required) to use, and whether you qualify for SDI through EDD. Job protection and pay are different questions.

Can we speak in Armenian, Spanish, or Russian?

Yes. Consultations may be available in those languages with an attorney.

I work at a small shop with fewer than five employees — do these rules apply?

Many PDL, CFRA, and FEHA discrimination rules generally apply to employers of five or more. Harassment rules can apply in smaller workplaces. Call so we can sort what may fit.

Where might a case be heard?

Often through CRD first for FEHA matters, then possibly Los Angeles Superior Court (including the Glendale Courthouse for many local civil filings). Confirm venue with counsel and the court locator.

How soon should I call?

Sooner is better — especially if leave was denied, you were pushed out after disclosure, or a deadline to file with CRD is approaching.
