Mental disability under FEHA (focus of this page)
CRD lists mental disability among protected characteristics. California Attorney General employment-disability materials note that mental health disabilities under FEHA can include conditions such as clinical depression, bipolar disorder, and other impairments that limit major life activities, and that FEHA’s definitions are generally broader than the ADA. The same materials note that FEHA’s mental-disability definition does not include sexual behavior disorders, compulsive gambling, kleptomania, pyromania, or disorders resulting from current unlawful drug use. Whether any condition is covered is fact-specific.
For the full FEHA disability framework—including the interactive process and failure-to-accommodate issues—see our hub page: disability discrimination & reasonable accommodation.
Accommodations often discussed for mental disabilities
The full interactive-process primer lives on our disability discrimination & reasonable accommodation hub. Mental-disability conversations on this page frequently involve:
- Flexible start times or reduced distractions
- Time off for therapy or medication adjustment
- Modified supervision or communication methods
- Leave as an accommodation when CFRA/FMLA leave is exhausted—whether that fits depends on the facts
Privacy matters: share medical details as needed for the interactive process, and ask an attorney how to document requests without oversharing.
Harassment and stigma
Mocking mental health treatment or using disability-related slurs may raise harassment concerns—see hostile work environment.
Injured at work?
A workplace injury—or the stress and recovery that follow—can raise mental-disability accommodation questions alongside workers’ compensation and other employment rights. See our injured at work hub and the disability discrimination & accommodation hub.
Filing with CRD
FEHA employment discrimination complaints are generally filed with CRD within three years of the alleged act. You generally must file with CRD even if you want to go to court. Call promptly. MAGISA LAW reviews every case.
